Impactiv8 Pty Ltd (ABN 88 620 029 656) is an Australian company based in Victoria. We operate three brands, and this one policy covers all of them:
- Impactiv8 (impactiv8.com.au), the company behind everything we do, including our AI coaching, workshops, speaking, the Impactiv8 Training Portal and our free downloads.
- AI Mega Success (aimegasuccess.com and its redirect domains, including aimegasuccess.com.au, aimegaclass.com, aimegaacademy.com and clickengageconvert.com), our AI training and membership brand: the AI MegaClasses, the AI Mega Success Academy and the AI Mega Success System.
- Lead Activator (LeadActivator.com), our all-in-one sales and marketing platform, also known inside the AI Mega Success System as the AI Mega Machine.
In this policy, "we", "us" and "our" mean Impactiv8 Pty Ltd, trading under any of these brands. The policy applies to personal information we collect through our websites, our forms, calendars and chat agents, our email and SMS communications, our live and recorded sessions, our training portals and member areas, our social media accounts, and when you deal with us in person or by phone.
We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles. If you're outside Australia, section 11 explains what that means for you.
A note for Lead Activator users. If you use Lead Activator to run your own business, you store your customers' information in it. Section 6 explains how we handle that information on your behalf, and what stays your responsibility.
What we collect depends on how you deal with us. It may include:
- your name, email address, phone number, business name, website and postal address
- your purchase history and subscription details, and the payment details you enter at checkout (card numbers are handled by our payment providers, Stripe and PayPal, and are never stored by us)
- responses to our surveys, quizzes, applications and onboarding forms, including join and cancellation surveys
- your questions, comments and posts inside our member community and live sessions
- recordings of live training, mentoring and coaching sessions you attend, which include your name, voice, image and anything you say or share on screen
- Loom videos we record to answer your questions or walk you through a process, which may include your account, your screen or your business information
- conversations you have with our AI chat or voice agents, and with our team by email, SMS, phone or social media
- testimonials and feedback you give us
- how you use our websites, emails, portals and platform (pages visited, links clicked, videos watched, progress through training, features used)
- if you connect with us at an event, the business card, notes or recording of our conversation that we use to follow up
- if you're a coaching or implementation client, the business information you share so we can do the work with you: your accounts, content, systems and knowledge files
- if you're a Lead Activator user, your account details, billing information, usage data and support history
We don't ask for sensitive information (such as health, religion, political opinions or racial or ethnic origin) and we ask that you don't share it in the community or in sessions. If it comes up anyway, we handle it under the stricter rules the Privacy Act sets for sensitive information, and only for the purpose it was shared.
We collect information when you:
- fill in a form on one of our websites or landing pages, or at a checkout
- book a call through one of our calendars
- chat with our AI chat or voice agents, or message us on social media
- reply to an email or SMS
- join a live session on Zoom, post in the chat, or attend a session in person
- sign up for, log in to or use the Impactiv8 Training Portal, a member area or Lead Activator
- complete a survey or give us feedback
- speak with us at an event or over the phone
- share files, logins or business information with us as a coaching or implementation client
We may also receive information from third parties, for example when a referral partner introduces you to us with your permission, or when you register for an event we're speaking at. Where that happens, we'll tell you where it came from when we first contact you.
Live sessions are recorded. Every live MegaClass, MegaDrop, Success Sprint, Q&A, mentoring and coaching session is recorded, and the recording is made available to the people entitled to it: members, ticket holders or the client. By attending with your camera or microphone on, or by posting in the chat, you consent to being included in the recording. If you'd rather not appear, keep your camera and microphone off and use a display name of your choosing. You'll still get the recording. Recordings of private workshops, team training and coaching sessions are shared only with that organisation or client, and are never used in our marketing or other programs without written permission.
We also use cookies and similar technologies on our websites. Section 7 explains what they do and how to manage them.
We use your information to:
- deliver what you've bought or signed up for: classes, memberships, coaching, software, freebies, and access to the right portals, recordings and communities
- process payments, manage subscriptions and keep the records the law requires
- answer your questions and support you, including by recording a Loom video when a walkthrough explains it better than an email
- create the guides and standard operating procedures we use to support you and train our team
- send you the emails and SMS you've opted in to, including training reminders, offers and our weekly insights
- improve our training, products and platform, including by reviewing survey responses, session questions and how members use the portal
- run our business, including analytics, security, fraud prevention and meeting our legal obligations
Marketing. We only send marketing emails or SMS to people who have opted in, bought from us, or asked us for something (such as a free download) and would reasonably expect to hear from us. Every email has an unsubscribe link and every SMS accepts a STOP reply. You can opt out at any time and we'll action it promptly. We don't use sensitive information for marketing.
Organisations we work with. Information an organisation shares with us in a session or an engagement is used only to deliver that work. We don't name organisations as clients, or use their information in our teaching or marketing, without written permission.
We never sell your personal information.
We practise what we teach. AI tools are part of how we run this business, and some of your information passes through them. Here's how, and what we don't do.
- Drafting and summarising. We use AI assistants (currently Claude by Anthropic and ChatGPT by OpenAI) to draft replies to your emails and messages, summarise recordings, transcripts and meeting notes, organise survey responses and feedback, and help write our guides and procedures. A person reviews everything before it's sent or acted on.
- Chat and voice agents. The chat and voice assistants on our websites and in our messaging channels are AI agents run through Lead Activator. They can answer questions, book calls and take your details. They don't make decisions about you. A person reviews enquiries and handles anything the agent can't.
- Understanding our customers. We use AI to look for patterns across survey responses, session questions and feedback so we can improve our training. Where practical we de-identify this information first.
- AI features inside our tools. Some of the platforms we use (such as Zoom, Loom and Lead Activator) have their own AI features, for example meeting summaries, transcripts and titles. Where we use them, the same rules apply: they help us work faster and a person stays in charge.
- What we don't do. We don't use your personal information to train AI models. We use business accounts with our AI providers with training on our data switched off. We don't use AI to make automated decisions that have a legal or similarly significant effect on you, such as pricing, eligibility, access or refunds. Those decisions are made by people.
If you'd prefer that your emails, recordings or files aren't processed with AI tools, tell us and we'll accommodate that where we reasonably can.
We share personal information only with the service providers we need to run the business, with a referral partner when you've asked us to introduce you, and where the law requires it.

Our team also includes people working outside Australia (currently in the Philippines) who access our systems to support you.
This means your information may be stored in, or accessed from, the United States, Canada and the Philippines, where privacy laws differ from Australia's. We choose providers with strong security and privacy commitments and data processing terms, and we take reasonable steps to make sure your information is handled in line with the Australian Privacy Principles wherever it goes.
If you use Lead Activator for your business. When you store your customers' or contacts' information in Lead Activator, you are responsible for that information and we process it on your behalf and on your instructions. In practice that means:
- we and our platform provider, HighLevel, act as processors of your customers' data, not owners of it
- we don't use your customers' information for our own marketing, and we don't share it with anyone except the sub-processors needed to run the platform
- our team may access your account to support you, set things up or fix problems, and only for those purposes
- you are responsible for having your own privacy policy, for getting the consents you need from your contacts (including for email and SMS marketing under the Spam Act 2003), and for how you use the platform's AI features with your contacts
- if you close your account, we'll delete or return your data in line with our platform terms
Our websites use cookies and similar technologies to make the sites work, understand how they're used, and show you our ads on other platforms. The main ones are:
- Google Analytics, to measure how the sites are used
- Google Ads, Meta Pixel, LinkedIn Insight Tag and TikTok Pixel, to measure whether our ads worked and to show you relevant ads on those platforms
- Lead Activator tracking, to connect your visits to your enquiry or account so we can support you properly
Cookies generally don't identify you personally on their own. You can control them through your browser settings, and opt out of personalised advertising through Google Ads Settings, your Meta ad preferences, and the Your Online Choices website. Turning cookies off won't stop the sites working, though some features may not behave as well.
We love sharing results. We only publish a testimonial, screenshot, recording clip or Star Story with your permission, and we'll show you how we plan to use it. You can withdraw that permission at any time by emailing us, and we'll stop using it in new material. We may not be able to remove it from material already printed or published elsewhere.
What you post in our member communities and session chats can be seen by other members, so please don't share anything you wouldn't want other members to see. We moderate the communities, and we may use the questions asked in sessions and communities, de-identified, to shape future training.
We store your information in ways that reasonably protect it from misuse, loss, unauthorised access, modification or disclosure, including access controls, two-factor authentication on our accounts, and providers with independently audited security.
How long we keep it:
- client files and transaction records: up to 7 years, to meet our record-keeping obligations
- session recordings: for as long as the training or program they belong to is offered, then deleted or archived
- coaching call recordings: for the duration of your engagement plus a reasonable period so you can access them, unless you ask us to delete them sooner
- Loom walkthroughs: until they're no longer needed to support you or our team
- CRM records: until you ask us to delete them, or after an extended period of inactivity
- survey responses: de-identified after analysis where practical
When we no longer need your information, we take reasonable steps to delete or de-identify it.
If something goes wrong. We have a Data Breach Response Plan. If we have a data breach that is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner as required by the Notifiable Data Breaches scheme, and tell you what happened and what you can do about it.
You can:
- access the personal information we hold about you
- correct it if it's wrong or out of date (members and Lead Activator users can update most details themselves inside their account)
- unsubscribe from marketing at any time using the link in any email or by replying STOP to any SMS
- ask us to delete your information, which we'll do unless we need to keep it for legal or record-keeping reasons, in which case we'll tell you
- withdraw consent to a testimonial, a recording or AI processing, as described above
To do any of these, contact us using the details in section 14. We'll respond within 30 days, and we don't charge for reasonable requests.
If you're in the UK or EU. Our services are designed for Australian businesses and we don't specifically target people in the UK or EU. If the GDPR or UK GDPR applies to you, you have rights to access, correct, delete, restrict or port your information and to object to processing, and you have the right to complain to your local data protection authority. Contact us and we'll honour those rights.
Children
Our services are for business owners and professionals and are not directed at anyone under 18. We don't knowingly collect personal information from children. If you believe we have, contact us and we'll delete it.
If you have a concern about how we've handled your personal information, contact us using the details below. All complaints are considered by Loren Bartley. We may ask you for more detail to understand the concern, and we'll respond within 30 days. If we agree your complaint is well founded, we'll work with you to put it right.

This policy applies alongside our Terms of Service, which cover purchases, memberships, refunds and use of Lead Activator.
